Fajiri is a group organization designed for registered active members in good standing to run its affairs. It’s a forum for friends and family members to achieve a common goal by adding and posting onstruction and other projects through their dashboard on this Website. Members are independent skilled workers, entrepreneurs, business developers, engineers, executives, partners, architects, builders, and other construction skilled workers that are placed and defined in seven categories based on the job and their status.

2. Eligibility to use the Website and Services
To register on our Website, you must be eighteen (18) years of age or legally an adult in the jurisdiction you are based in and you are able to understand and agree to the terms, conditions, obligations, representations, and warranties set forth in these Terms of Use. If you are under the age of 18 years, or a minor, you may use our Website and Cash Flow Business Services only with the involvement of a parent or legal guardian.

If you are a user located in Nigeria, you are contracting with Fajiri Construction Ltd, Fajiri Security Services Ltd. If you are a user in Canada or anywhere else outside the United States, you are contracting with Fajiri Healthcare Agency. Please be aware that some Fajiri Cash Flow Business Services may not be available in your region due to third party or compliance restrictions.

If you choose to register for any of the Cash Flow Business Services, you agree to provide and maintain true, accurate, current and complete information about yourself and any project added on the platform. You must register on the Website using your true identity. You must keep your registration information up to date. To create an account, you must be of legal age in your jurisdiction, you must have a valid government issued ID card and you agree that Fajiri reserves the right to verify your identity on account creation.

6. General Use
The content on this Website is provided for general information only and should not be relied upon or used as the sole basis for making decisions including any financial planning without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the content or any other material on this Website is at your own risk.

7. Transaction Charges
You acknowledge that for us to cover all our cloud hosting, administration, and other operating costs, as well as cover your healthcare and life insurance premiums, you are required to pay a yearly renewable depending on your type of membership. For fundraisers we must deduct a 10% commission from every fajirifunders amount received by you. Your funders shall indirectly cover your transaction fees, the commission, campaign project mount, and other expenses, leaving you with zero financial liability. In cases where your funders no longer wish to support you, you agree to cover any outstanding payments or replace them with new funders.

8. Safety; Your Interactions with Other Members
Though we strive to encourage a respectful member experience through features like the double opt-in that allows members to communicate only after they have both indicated interest in one another, it is not responsible for the conduct of members on or off of the Website. You agree to use caution in all interactions with other members, particularly if you decide to communicate off the Website or meet in person. You agree that you will not provide your financial information (for example, your credit card or bank account information), or wire or otherwise send money, to other members and we shall not be responsible for any loss due to such disclosure. You understand that we do not conduct criminal background checks on its members or otherwise inquire into the background of its members. We make no representations or warranties as to the conduct of members and cannot be held liable for the same.

9. Limited License; Restriction on Website use
Subject to your agreement to abide by these Terms of Use, Fajiri grants you a limited, revocable, nonexclusive, nontransferable license to view, store, bookmark, download and print the content within the Website for your personal, informational, and noncommercial use or to the extent permitted by Fajiri.

You agree not to access or use the Website for any other purpose including, without limitation, any purpose that is prohibited by these Terms of Use or that is otherwise unlawful. You are not authorized to alter, modify, or create derivative works of any such content without first obtaining our express written permission.

10. Fajiril Rights
By creating an account, you grant to us a worldwide, transferable, sub-licensable, royalty- free, right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, modify and distribute information you authorize us to access from Facebook or any other third-party sites, as well as any information you post, upload, display or otherwise make available on the Website or transmit to other members. Our license to your Content shall be non-exclusive, except that our license shall be exclusive with respect to derivative works created through use of the Website and our Services. For example, Fajiril would have an exclusive license to screenshots of the Website that include your information or posts. In addition, so that Fajiri can prevent the use of your information outside of the Website, you authorize Fajiri to act on your behalf with respect to infringing uses of your information taken from the Cash Flow Business Services by other members or third parties.

11. Links to Third Party Sites
As a convenience to you, we may provide, on our Website, links to web sites or other resources operated by other entities. If you use these sites, you will leave this Website. We have no control over such websites and resources or their privacy policies. We make no warranty or representation regarding, and do not endorse, any linked websites or the information appearing thereon or any of the products or services described thereon.

12. Third Party Service Providers
Fajiri may use third party service providers, vendors, and licensors to assist in providing you with the Services. Our Website is not a money transfer platform until the Lucrative Financial Activities Cash Flow Business sector is established. At the moment, Fajiri is not a money transfer business nor is our Website a money transfer platform. We are not licensed to transfer funds for or on behalf of our users. Fajiri only partners and uses third party money transfer platforms, payment gateways, or services such as Paystack, Flutterwave.com, stripes.com. You understand that these third-party service providers could have their own terms of use and other policies which shall apply to you as well as us.

13. Account Disabling
You agree that we may at our discretion, temporarily or permanently disable your account (pending compliance investigation) if, (a) you are non-compliant with any of these Terms of Use or any other Fajiri member policy or policies, (b) you have used the Website in any way in which it was not intended to be used, (c) you have tried to use the Website for illegal gains or purposes, (d) if we have reason to believe that information provided by you during registration is incorrect, (e) funds are being used in a prohibited manner or for reasons other than the funds they were collected against, (f) operating more than one profile at a time, (g) if you are not of legal age and do not have the consent of a parent or legal guardian, (h) if you are under investigation by local law enforcement authorities, (i) if you fundraise with false pretence, (j) if you are found guilty of giving bribes, incentives, and favors to secure support, (k) If required in order to comply with a court order, subpoena, writ, injunction, or as otherwise required under applicable laws and regulations, or (l) we receive a complaint or report for copyright infringement, spamming, harassment, racism, verbal abuse, threats, fraud, and other prohibited behaviohur which is against our code of ethics.

You acknowledge and agree that if we disable access to your account, you may be prevented from accessing the Website, your account details or any files or other content, which is contained in your account.

In case of any non-compliance by you, Fajiri retains the right to investigate the matter. During any investigations, funds in your account shall be frozen and the user shall not be able to access the same. On completion of the investigation, if in Fajiri’s sole discretion the user has been found non-compliant, your account shall be deactivated and the funds in your account shall be transferred to your account.

In case of a criminal or civil breach which requires intervention from law enforcement, your account shall be deactivated and any funds in it shall remain frozen until the regulatory authorities allow them to be refunded to you. 14. Your Information
We respect your privacy. Any personally identifiable information you may provide to Fajiri via this Site is protected by the Privacy Policy associated with this Site. You are responsible for all information given to us under your e-mail address in combination with your password. You must immediately notify us of any unauthorized use of your e-mail address and/or password, or any breach of security known to you.

15. Public Display of Information

16. Monitoring Rights

17. Fajiri Membership Policies, Rules and Regulations
If you choose to be a Fajiri member you understand and agree that Fajiri has two types of
membership, the Fajiri Identification Membership (FIM) and the Fajiri Project Membership
(FPM). Your use of this website means you have agreed to obey and follow the process of
membership registration, compensation plan, rules, policies dos and don’ts as stipulated and
described below and in the Fajiri Member Handbook and Directory as well as the benefits
described in the book titled Fajiri Membership Benefits.

Every registered member in good standing has a call of duty, and responsibility to NEVER
INDULGE and NOT:
1. Open, start or set up any foundation, organization, or business that is in direct competition, or conflict with Fajiri or its subsidiaries, affiliates, and partners from the day or after the time they became a member.
2. Develop, copy or use our patent and licensed software application to conduct similar operations.
3. Sexually, verbally, or physically abuse, harass, or insult another member, client, partner, associate, colleague or persons in any form whatsoever.
4. Use Fajiri’s corporate pr organization name, intellectual properties, trademarks, logos, web application content, and printing materials, without permission.
5. Reject invitations for membership meetings, gatherings, and events unless a member cannot attend due to other engagements or emergencies.
6. Disrespect or argue with clients, fellow members, management, or partners. Everyone associated with the company should be treated with equal, mutual respect, honor, love, and kindness.
7. Discriminate based on race, color, tribe, gender, religion, education, class, or status.
8. Print to sell, distribute, circulate, or reproduce, Fajiri’s corporate items, handbooks, magazines, souvenirs, t-shirts, hats, handkerchiefs, mugs, etc without written permission.
9. Perform the activities and obligations they are not registered under. For example, FIMs are prohibited from managing, and supervising any projects even if they have the certification, experience or qualification to do so.
10. Abuse the privileges, support, rewards, and benefits the company gives to its active members.
11. Ignore or fail to report anyone causing a disturbance, exhibiting any destructive, offensive behaviors, and compromising anything belonging to Fajiri or any member.
12. Open bank accounts or set up financial instruments for the specific purpose of receiving payments to defraud the company, fellow members, its clients, partners, and affiliates.
13. Receive any payments, cash, checks or financial instruments directly from clients in private bank accounts or accounts not approved for collection of registration payments or projects. All payments must be paid into Fajiri’s designated and approved bank accounts.
14. Accept any bribes in any form to betray the company, clients or fellow members.
15. Compromise on quality of service and product delivery
16. Break or disobey any federal, state, local or municipal government laws of the land you reside in during the performance of your obligations and responsibilities as a member Fajiri.
17. Use Fajiri, the organization’s name to enter into a binding contract without written permission. All contracts must be signed and approved by Fajiri corporate management.
18. Supervise or manage a project without obtaining the proper licensing, permits, building codes, certifications, and approval from the appropriate authorities.
19. Organize rallies, shows, promotions, launches, or any events without written permission of the company’s management.
20. Make false claims about the Fajiri organization, its foundation, corporate entities, against any member, client, partner, colleague, staff, employee, or persons associated with the organization.
21. Fabricate lies purposely for fundraising and illegally securing financial or any kind of monetary support.
22. Double cross, double deal, or take advantage of any client, member, colleague, partner, affiliate, or person.
23. Intentionally pass or deliver any wrong, incorrect, erroneous, or inaccurate information to any member, client, partner, or affiliate member regarding our nature of business and mode of operations.
24. Diverge any confidential or private information that could cause a negative impact or destruction to any Fajiri’s global affairs and reputation.
25. Duplicate the business model of the organization and try to use it to cause disunity and division amongst fellow members.
26. Negotiate pricing, cost, estimate, or ask a client to deal with you directly without the presence of a business developer member, not reporting or entering the project details into the system after agreeing to the membership agreement.
27. Initiate and accept projects that you cannot handle due to overload, burnout, stress, or any other related reasons.
28. Initiate and accept projects when sick, infected with disease, disabled, or mentally exhausted.
29. Initiate and accept projects in areas or communities that are unsafe and could endanger lives and properties.
30. Initiate and accept projects that you have no experience, certification, or knowledge about.
31. Initiate and accept projects that are not within your service area, city, or state or that will be unmotorable, and very inconvenient to complete.
32. Conspire with another member, person, or groups of persons to work against the foundation and Fajiri’s organization policies and overall vision.

As a Fajiri active and dedicated member, you agree and understand that you are responsible
and liable for the following conduct:

1. Behaviors that cause self-inflicted pain and loses to yourself and others in the cause of carrying out your membership obligations.
2. Any fraud, forgery, or related criminal activities committed against the organization, fellow members, clients or partners.
3. Jobs or projects you embark on knowing that you have no skills, license, permits, knowledge or expertise to perform that particular job or project.
4. Any misrepresentation, or false claims about Fajiri organization, members, affiliates, subsidiaries, and partners when dealing and relating with clients, organizations, persons or groups of persons.
5. Knowingly encroaching, trespassing, or stealing someone else property for the purpose of illegally taking possession of such properties.
6. Entering into a binding service agreement with a client in Fajiri’s name without approval or failing to report or enter the details of the project into the designated system.
7. Infringing on any of Fajiri’s trademarks or intellectual properties to misrepresent and defraud unsuspecting clients, partners, affiliates or potential members of the company.
8. Fabricating lies, creating false, fake, or forged documents in print, online and computer systems to trick, deceive, clients, members, and partners in the process destroying and tarnishing Fajiri’s corporate image or reputation, using the tools we have provided.
9. Deliberately ignoring a Fajiri Family member who is in trouble financially, physically, spiritually, and emotionally and needs help and mentorship.

18. The Fajiri Member Handbook and Directory
To better understand the Fajiri business methods, membership program, referral program, cash flow business services, policies, rules and regulations, you agree to order and purchase the Fajiri Member Handbook and Directory each year the book is revised and released. You understand that failure to renew your FIM or FPM membership yearly, order a copy of the Fajiri Member Handbook and Directory yearly and pay your dues/levies to the Fajiri Foundation yearly, we reserve the right to refuse you access to this Website.

19. Advertisements
In consideration for using the Website and our Cash Flow Business Services, you agree that we, our affiliates, and our third-party partners may place advertising on the Website. By submitting suggestions or feedback to us regarding our Cash Flow Business Services and Website, you agree that we may use and share such feedback for any purpose without compensating you.

20. Intellectual Property
The Website and its content are protected by applicable copyright, trademark, unfair competition
and other laws and may not be used, copied, distributed, imitated or posted, in whole or in part,
except as expressly provided herein. All images shown here have been digitized by us. No other

without our prior written permission. All copyright, trademarks and all other intellectual property

21. Legal Compliance
You shall comply with all laws and regulations that are applicable to you in the jurisdiction you are based on and you will use the Site in compliance with these Terms and applicable law. You warrant and represent that you are not a person who is barred from using the Cash Flow Business Services under the laws of Nigeria, the United States, Canada or any other applicable jurisdiction– meaning that you do not appear in the U.S. Treasury Department’s list of Specially Designated Nationals, EFCC or FINTRAC or face any other similar prohibition

21. Pre- Authorized Debit Agreement (For Canadian Users)
Payments shall be made using a pre-authorized payment service. You agree and approve Pre-Authorized Debit (PAD) from your bank account, credit card, or Interac card to top-up your support wallet using our third-party service. You authorize Fajiri to debit funds for regular, membership renewal payments, or recurring payments and/or one-time payments based on your payment obligations to Fajiri Construction Ltd. You expressly waive any requirement including any legislative or regulatory requirement for pre-notification prior to such debit. Transaction dates that fall on a weekend or holiday will be processed the next business day.

22. Canceling your Pre- Authorized Debit Agreement (For Canadian Users)
You may revoke your authorization at any time, subject to providing notice 10 business days before the next scheduled debit. You can obtain a sample cancellation form or more information on your rights to cancel a Pre- Authorized Debit Agreement at your financial institution or by visiting the www.payments.ca/paying-pre-authorized-debit. You can also reach out directly to us and cancel your authorization at unite @ fajiri.com with the subject “Cancel PAD”.

In the event any debit does not comply with this agreement, for example, if the debit was not withdrawn in accordance with this authorization or amounts were withdrawn after your consent was revoked, then, you will have the right to receive reimbursement for any debt that is not authorized or is not consistent with this clause based on the timeline set out by the Canadian Payment Association. To obtain more information on your recourse rights, contact your financial institution or the Canadian Payment Association. A claim to this effect must be made to your financial institution following the procedure it will provide for that purpose.

23. No Warranty
The information contained in the Website is provided on an “as is” and “as available” basis. Fajiri may, in its sole discretion and at any time, discontinue the Website, or any part thereof, with or without notice. We assume no liability or responsibility for any errors or omissions in respect of the Website. Further, we do not represent or warrant that any aspect of the Website will work properly or will be continuously available. We hereby disclaim any and all warranties and representations, whether express or implied, oral or written, including, without limitation, any and all implied warranties of merchantability, reasonable care, security, quality, timeliness, availability, completeness, reliability, accuracy, and/or fitness for a particular purpose, in each instance in respect of the Website. Furthermore, we expressly disclaim any and all warranties of title and/or non-infringement in respect of the Website. If your jurisdiction does not allow disclaimer of warranties, then, this provision does not apply to you.

24. Termination of Account (Deactivation and Suspension)
You may terminate your account at any time, for any reason, by following the instructions in “Settings” on the Website, however if you use a third-party payment account, you will need to manage in app purchases through such account (e.g., iTunes, Google Play) to avoid additional billing. We may terminate your account at any time without notice if it believes that you have violated these Terms of Use. After your account is terminated, this Agreement will terminate, except for those provisions which shall generally by their interpretation survive such termination.

25. In-App Purchases
From time to time, we may offer products and services for purchase (“in app purchases”) through iTunes, Google Play, carrier billing, Scrapabill direct billing or other payment platforms authorized by us. If you choose to make an in app purchase, you will be prompted to confirm your purchase with the applicable payment provider, and your method of payment (be it your card or a third party account such as Google Play or iTunes) (your “Payment Method”) will be charged for the in app purchase at the prices displayed to you for the service(s) you’ve selected as well as any sales or similar taxes that may be imposed on your payments, and you authorize us or the third party account, as applicable, to charge you. If you purchase an auto-recurring periodic subscription through an in-app purchase, your Payment Method will continue to be billed for the subscription until you cancel. After your initial subscription commitment period, and again after any subsequent subscription period, your subscription will automatically continue for an additional equivalent period, at the price you agreed to when subscribing. If you want to change or terminate your subscription, you will need to log in to your third-party account (or Settings on Fajiri) and follow instructions to terminate or cancel your subscription, even if you have otherwise deleted your account with us or if you have deleted the Fajiri application from
your device. Deleting your account on Fajiril or deleting the Fajiri application from your device does not terminate or cancel your subscription.

26. Direct Payments to Fajiri
If you pay Fajiril directly, Fajiri may correct any billing errors or mistakes that it makes even if it has already requested or received payment. If you initiate a chargeback or otherwise reverse a payment made with your Payment Method, Fajiril may terminate your account immediately in its sole discretion.

You may edit your Payment Method information by visiting Fajiri and going to Settings. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not edit your Payment Method information, terminate or cancel your subscription, you remain responsible for any uncollected amounts and authorize us to continue billing the Payment Method, as it may be updated. This may result in a change to your payment billing dates. In addition, you authorize us to obtain updated or replacement expiration dates and card numbers for your credit or debit card as provided by your credit or debit card issuer. The terms of your payment will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer or other provider of your chosen Payment Method. If you reside outside of the Americas, you agree that your payment to Fajiri will be through a Fajiri profile account.

27. Virtual Items
From time to time, you may be able to purchase or earn a limited, personal, non-transferable, non-sublicensable, revocable license to use “Virtual Items”, which could include virtual products or virtual “coins” or other units that are exchangeable within the Service for virtual products (collectively, “Virtual Items”). Any Virtual Item balance shown in your account does not constitute a real-world balance or reflect any stored value, but instead constitutes a measurement of the extent of your license. All purchases and redemptions of virtual items made through the service are final and non-refundable. You acknowledge that Fajiri is not required to provide a refund in respect of virtual items for any reason, and that you will not receive money or other compensation for unused virtual items when an account is closed, whether such closure was voluntary or involuntary.

28. Limitation of Liability
Except where prohibited by law, in no event will we be liable for (a) any damages of any nature whatsoever resulting from, or related to, the loss, delay or inability to use the Website, the loss of any content obtained through the Website, or the inaccuracy of any content, or (b) any indirect, consequential, special, incidental or punitive damages whatsoever, including, without limitation, damages for loss of profits arising out of or in any way connected with these Terms of Use or otherwise arising out of the use or performance of the Website, in each of (a) and (b) above whether based in contract, tort, negligence, strict liability or otherwise.

29. Indemnity and Release
You shall indemnify and hold us harmless from any claim or demand, or actions including reasonable attorney’s fees, made by any third party or penalty imposed due to or arising out of your breach of these Terms of Use or any document incorporated by reference, or your violation of any law, rules, regulations or the rights of a third party.
